Regulatory changes
Tariffs: BIS tightened the "U.S. content" test for steel, aluminum and copper
BIS issued guidance to CBP defining U.S. content for USMCA-qualifying goods of Canada and Mexico under Proclamation 11032 (the June 1, 2026 adjustment to the aluminum, steel and copper tariff regimes). U.S. content means parts wholly obtained, entirely produced or substantially transformed in the United States, plus, to the extent not already counted, value attributable to steel melted and poured or aluminum and copper smelted and cast in the U.S. Effective 12:01 a.m. ET Oct 14, 2026, applying to goods entered or withdrawn from warehouse for consumption on or after that time. Hits anyone sourcing structural metal, enclosures, castings or wiring through Canadian or Mexican tier ones. (Federal Register, Oct 14)
FCC Upper C-band rule takes effect, satellite transition plans due Nov 5
The Upper C-band order (3.98–4.2 GHz) published in the Federal Register on Oct 19, with the amendatory instructions to 47 CFR 27.1412(e) and 27.1419 effective that day. Satellite operators must file transition plans for clearing 4.0–4.16 GHz by Nov 5, 2026. Affects FSS operators with Upper C-band downlinks and the terrestrial licensees inheriting the spectrum. (Federal Register, Oct 19)
NRC renewed the AP1000 design certification through 2066 and made Vogtle 4 the reference plant
Issued as a direct final rule with a companion proposed rule on Oct 14, extending certification from 2046 to 2066 and folding Vogtle 3 and 4 construction lessons into the certified design so future applicants need not re-license changes already evaluated. Effective Dec 28, 2026 absent significant adverse comment; comments close Nov 13. Matters to anyone filing a new AP1000 COL, and to the Polish and Dutch programs now ordering long-lead items. (Federal Register, Oct 14, ANS, Oct 16)
New drone exclusion zone along the U.S.–Mexico border
DOT, the Department of War and DHS jointly barred unauthorized drone flights from the surface to 400 ft AGL within one nautical mile north of the Mexico border, implemented through FAA NOTAMs, with CBP approval requested at least 48 hours ahead and carve-outs for law enforcement, firefighting and search and rescue. The effective date is inconsistent across sources: the departments' announcement points to Oct 16, while NOTAM data reportedly shows 0000 UTC Oct 20 running to Oct 19, 2027. Anyone flying survey, ag, pipeline or infrastructure work in the border corridor should treat it as live now. (The Rio Times, Oct 17)
FAA Part 108 BVLOS is still sitting at OIRA
No publication, no effective date. Reporting as of this month puts it at roughly 90 days under OMB review and months past target, and no OIRA action date falls in the next ten days. The single largest pending variable for every BVLOS business model remains unresolved. (Status tracker, Oct 2026)
FCC added Pentagon letters to the DJI and Autel dockets without changing their status
On Oct 14 the Public Safety and Homeland Security Bureau placed previously submitted Department of War Section 1709 letters into ET Dockets 26-22 (DJI) and 26-23 (Autel), publishing only redacted unclassified cover pages. The FCC states it did not rely on those letters when adding the firms to the Covered List, so there is no new restriction; DJI's reconsideration petition and Autel's application for review are both still pending. (DroneDJ, Oct 15)
ITAR: USML Category XX(a) modification took effect Oct 19
The DDTC final rule narrowing Category XX(a) (submersible and oceanographic equipment) became effective Oct 19, 2026. Relevant if you build or export subsea or maritime autonomy hardware. (Federal Register)

Robot safety: South Korea cleared the first multi-humanoid factory trial
Korea's industrial-convergence regulatory sandbox approved a 20-humanoid deployment for Robros, exempting it from safety rules written around fencing workers off from fixed industrial robots. Sites span semiconductor packaging cleaning (Nepes), auto body part positioning (Sungwoo Hitech), shipbuilding material stacking (HD Hyundai Samho) and cold-chain packaging. This is the first real regulatory precedent for unfenced humanoids on a production floor, and OSHA has produced nothing comparable. (Seoul Economic Daily, Oct 13)
CHIPS: GF award amended, Commerce takes an equity stake
Up to $955M of GlobalFoundries' existing CHIPS award was reallocated against a raised $5B capital commitment at Malta NY and Burlington VT, covering silicon photonics, SiGe and what is described as the first U.S. source of silicon interposers for advanced packaging. The total award does not increase, and Commerce takes roughly a 4% equity stake in GF. (Semiconductor Today, Oct 16)

What the week actually signals. Construction autonomy is being repriced hard: Bedrock at $3.5B pre, ICON at $1.4B with BlackRock and Baillie Gifford writing the check, Origin out of stealth with Accel, all in the same week. Two separate strategic pairs showed up on the same cap tables (AMD Ventures plus Intel Capital in Salience Labs, ABB plus Southwire in Switched Source), which reads as incumbents buying optionality on interconnect and grid hardware rather than building it. And three same-day Chinese rounds landed in exactly the component tier Western builders import: precision planetary reducers (Sankai, several hundred million RMB), diamond-metal composites for chip thermal management (Yisheng, ~RMB 100M) and stellarator superconducting magnets (Yanchao Juneng, several hundred million RMB).

Lockheed is putting $300M into Grand Prairie TX advanced munitions, part of 6,000 new U.S. jobs and $8 to 9B through 2030 across 20+ facilities; the site grows past 735,000 sq ft, a highly automated 24-machine Hadrian cell run by Lockheed's own workforce should be operational in early 2027, and nearly 100 new advanced machines are expected by end-2026. L3Harris took a $250M follow-on from Lockheed for standard-range GMLRS rocket motors and says it has doubled SRM output. Lockheed also signed Avio for extended-range GMLRS and PrSM motors from its Hurt VA plant, with Avio citing over $500M committed to U.S. SRM capacity. X-Bow secured a Leidos deal for 3D-printed solid rocket boosters for the Army's Low-Cost Containerized Munition (LMT, Oct 14, L3Harris, Oct 13)
- Additive: Velo3D pre-announced Q3 revenue of about $19.5 to 20.5M, up roughly 43 to 51% YoY from $13.6M (unaudited, no new guidance), and Mears Machine ordered a sixth Sapphire XC dedicated to printing 70-30 copper-nickel, an alloy traditionally cast and used in seawater heat exchangers and shipbuilding (Velo3D, Oct 15)
- Thin this week: a Bloomberg report dated Oct 15 says a mineral stockpile is preparing up to $1B in loans; the figure, agency and minerals are unconfirmed. Geothermal and transmission were both thin, and no in-window BioMADE or DoD bioindustrial award surfaced
Week ahead
Oct 19 to 29.

Regulatory dates
- Oct 19. Comments close on the FAA's draft Programmatic EA for reentry vehicle operations in the marine environment, and on the NRC's draft reg guide on PRA results for non-light-water reactor risk-informed activities (FAA, NRC)
- Oct 22. Joint FERC-NRC Commission meeting, 1:00 to 3:30 p.m., on grid and nuclear interconnection. Also the Blue Origin LC-36A virtual hearing, NHTSA comments close on the THOR-50M test dummy, and FCC comments close on the RF-exposure remand in Environmental Health Trust v. FCC (NRC, NHTSA)
- Oct 26. NRC Modernization final rule takes effect (rulemaking procedure, FACA alignment, access and security). Same day: BIS comments close on the Defense Priorities and Allocations System directive and allocation orders issued under the presidential determination on recoverable critical minerals, and CBP's ACE Electronic Export Manifest for Rail Cargo takes effect (NRC, BIS)
- Oct 28. NRC Advanced Reactor Oversight Process workshop (9 a.m. to noon) and "License to Launch" Workshop #2, on moving from DOE authorization to NRC licensing (12:30 to 4:30 p.m.). PHMSA's ASME Code Section XII incorporation also takes effect (NRC)
- Oct 29. FCC October Open Meeting, seven tentative items, three of which matter here: an FNPRM releasing 25 MHz of mid-band spectrum for terrestrial, direct-to-device and hybrid use; an NPRM updating direct-to-device satellite service rules in licensed spectrum; and an R&O lifting the ban on drone operations in the 800 MHz cellular band. A fourth would bar recognition of test labs and certification bodies based in non-reciprocal economies, which is an equipment-authorization headache worth reading if you certify hardware offshore (FCC)
- Oct 30. Comments close on Blue Origin's request to raise LC-36A from 12 to 50 launches per year (Spaceflight Now)
- Nov 5 / Nov 9 / Nov 13. Just past the window but worth calendaring now: FCC Upper C-band satellite transition plans due Nov 5; comments close Nov 9 on the NRC's big EO 14300 proposed rule, "Regulatory Enhancements for Reactor Licensing, Decommissioning, and Operational Oversight," spanning 10 CFR 20, 21, 50, 52, 53, 55, 70, 72 and 75; AP1000 design-certification comments close Nov 13 (NRC proposed rule)
